Statewide Inventory of Untested Sexual Assault Kits

House Bill 49

House Bill 49 requires an annual audit of untested sexual assault kits (SAKs). These audits provide data that law enforcement can use to prioritize efforts to address the untested kits as well as evaluate their current practices and policies. The legislation also establishes timelines for SAK submission and analysis. The complete bill is available to read here.

Inventory Results

As required initially under Senate Bill 55 and now annually by House Bill 49, the Department of Public Safety (DPS) has worked with municipal police agencies across the state to conduct an inventory of unsubmitted SAKs. 33 of 44 police agencies complied with the request. A total of 811 untested victim SAKs were inventoried in 2020* . Currently DPS is working with municipal police departments to address their untested victim SAKs using capital funds provided by the state legislature. 

The chart below shows unsubmitted SAKs by department. Due to the Capital Project being well under way, many departments now report zero or nearly zero untested SAKs. The agency order of SAK send outs, resulted in Anchorage Police Department making up a larger percentage of remaining SAKs for the project.  For a complete list of unsubmitted SAKs by agency, please refer to the table.
 


* The total number of unsubmitted victim SAKs does not include those identified in AS 44.41.070 as
ineligible for testing  such as those that are scientifically unviable, does not meet CODIS eligibility requirements, or

SAKs belonging to anonymous victims. Should victims in anonymous cases wish to convert their case
to a reported case, their SAK could be eligible for testing.
